During the period from 1936 until he vacated the office in 1948 the county clerk of Trempealeau County issued hunting and
fishing licenses and collected the fees therefor. None of the fees collected by him were ever turned over to, or carried into
any account of the county. Until March, 1948 he personally remitted the fees, less his commissions, to the conservation commission.
His salary was fixed by resolution of the county board which also authorized him to retain commissions payable to him out
of the fees collected. None of the transactions carried on by him with respect to the licenses issued were recorded in any
of the county's books or records. In 1948, instead of remitting his own funds to cover for fees collected, he caused to be issued to the conservation commission
three checks of Trempealeau county aggregating $7,255.65, the proceeds of which were turned into the state treasury. The county
filed a claim for the return of the money with the Director of Budgets and Accounts, which was presented to the Legislature
and rejected. This action, brought against the state, resulted in judgment entered on July 11, 1951 dismissing the complaint.
The county appeals.
